Queens District Attorney Melinda Katz announced that Mark Gibbs was sentenced today to 11 and a half years in prison for wounding an off-duty correction officer during a shootout in broad daylight on a busy Jamaica street in July 2022.  His co-defendant, Sevaughn Green, is awaiting sentencing.

District Attorney Katz said: “This kind of reckless gun violence has absolutely no place on our streets and we will not let up in our efforts to end it. We applaud Correction Officer Donegan’s extraordinary bravery and commitment to protecting us.”

Gibbs, 24, of Parsons Blvd., pleaded guilty last month to criminal possession of a weapon in the second degree and was sentenced today to 11 and a half years in prison and five years of post-release supervision by Justice Gia Morris. Green, 21, of Dewitt Avenue in Brooklyn, is scheduled to be sentenced December 11.

According to the charges:

• On July 3, 2022, at approximately 8:03 p.m., David Donegan, an off-duty correction officer, observed an altercation in the intersection of 214^th Place and Jamaica Avenue in Jamaica and saw Green approach a man and attempt to punch him in the face.
• Green then walked up to Gibbs and retrieved a gun from Gibbs’ waistband. As Donegan attempted to break up the altercation, Gibbs pulled out a gun from his crossbody bag and began firing at Donegan.
• Donegan turned to run away and was hit in the back of his calf. He then drew his licensed firearm and returned fire, striking Gibbs three times in the torso. Gibbs fell to the ground. Green crouched down near him and shot at Donegan.  Donegan returned fire, striking Green in the leg.
• Donegan was treated a local hospital for the gunshot wound.
• No pedestrians were wounded.

Assistant District Attorney Gabriel Reale of the Career Criminal Major Crimes Bureau is prosecuting the case under the supervision of Assistant District Attorney Michael Whitney, Bureau Chief, and under the overall supervision of Executive Assistant District Attorney for Major Crimes Shawn Clark.
