D.A. BROWN: QUEENS MAN CHARGED WITH SEXUALLY ASSAULTING TWO BOYS AGED 11 AND 13 IN PARK IN COLLEGE POINT, QUEENS; FACES 50 YEARS IN PRISON

Queens District Attorney Richard A. Brown today announced that a Queens man has been charged with sexually assaulting two boys –- aged 11 and 13 –- in MacNeil Park in College Point, Queens and forcing them to engage in sexual relations. He faces 50 years in prison.

District Attorney Brown said, “According to the charges, the defendant lured two young boys into a secluded area of the park where he separately sexually assaulted them. It is alleged that the defendant is a threat to children and a clear and present danger to society. The charges will be vigorously prosecuted.”

The District Attorney identified the defendant as Timothy Felton, 31, of 111-17 113th Street in South Ozone Park, Queens. The defendant has been charged with Criminal Sexual Act in the First and Second Degree and Sexual Abuse in the First Degree and faces 50 years in prison if convicted.

According to the District Attorney, it is charged that on April 25 and April 26, 2005 at MacNeil Park at Poppenhusen Avenue and 119th Street in College Point, Queens the defendant engaged in sexual conduct with two young boys aged 11 and 13.

The District Attorney said that it is further charged that the sexual attacks included fondling of both victims and oral sexual contact with the 11 year old.

The defendant was apprehended yesterday by Police Officer Yanni Taveras of the 109th Precinct under the supervision of Deputy Inspector Thomas G. Cea, Commanding Officer, and arraigned earlier today in Queens Criminal Court before Judge Gene Lopez who remanded the defendant without bail and set a return date of May 16, 2005.

Assistant District Attorney P. Leigh Bishop of the District Attorney’s Special Victims Bureau is prosecuting the case under the supervision of Assistant District Attorneys Marjory D. Fisher, Bureau Chief, and Lucinda C. Suarez and Kenneth M. Appelbaum, Deputy Chiefs, and the overall supervision of Executive Assistant District Attorney for Major Crimes Charles A. Testagrossa and Deputy Executive Assistant District Attorney for Major Crimes Daniel A. Saunders.

It should be noted that criminal charges are merely accusations and that a defendant is presumed innocent until proven guilty.
